These Terms and Conditions govern the use of Dhaka Property, including the buyer app, seller app, website, APIs, notifications, memberships, support services, and related services.

1. Acceptance

By accessing or using Dhaka Property, you agree to these Terms. If you do not agree, do not use the services.

2. Our role

Dhaka Property is a technology platform that helps users discover, list, promote, enquire about, and manage property-related interactions.

Unless expressly stated in writing, Dhaka Property is not the owner, seller, buyer, landlord, tenant, developer, broker, or agent for any property, and is not a party to property sale, lease, rent, brokerage, booking, or other real estate agreements between users.

3. Independent verification

Users must independently verify property details, title, ownership, possession, price, approvals, taxes, charges, RERA status, documents, and transaction terms before making any decision or payment. Users should obtain legal, financial, tax, valuation, and technical advice where needed.

4. Accounts

You agree to provide accurate information, keep credentials and OTPs secure, use your own account, avoid impersonation, and accept responsibility for activity under your account.

5. Buyer and tenant responsibilities

Buyers and tenants are responsible for inspecting properties, verifying documents, confirming availability, checking RERA details where applicable, and making payments only after proper due diligence.

6. Seller, owner, agent, broker, and developer responsibilities

Users who create or manage listings must have authority to advertise the property, provide accurate and current information, upload only authorized content, comply with applicable laws, display RERA details where required, and remove or update unavailable or misleading listings.

7. RERA and legal compliance

Where RERA applies, sellers, developers, promoters, agents, and brokers must ensure their listings and advertisements comply with applicable state RERA rules. Dhaka Property does not certify RERA registration, title, approvals, possession, or transaction readiness unless expressly stated.

8. Listings and content

You confirm that you have rights to upload the content you submit. You grant Dhaka Property a non-exclusive, worldwide, royalty-free license to host, store, display, reproduce, publish, distribute, promote, and use your content for operating and improving the services.

You must not upload false, misleading, fraudulent, unlawful, infringing, abusive, discriminatory, spam, malware, or unauthorized content.

9. Communications

By using the services, you agree that Dhaka Property and relevant users may contact you about listings, enquiries, viewings, offers, applications, memberships, support, account activity, and service updates through app notifications, email, SMS, WhatsApp, phone, or other permitted channels.

10. Payments and memberships

Some services may require payment, subscription, membership, listing promotion, or platform fees. Fees, taxes, plan features, refunds, cancellations, and credits are governed by the applicable terms shown at the time of purchase.

11. Prohibited conduct

You must not use the services for fraud, fake listings, fake enquiries, illegal brokerage, identity misuse, harassment, scraping, reverse engineering, spam, malware, unauthorized data collection, bypassing security, or any activity that violates law or these Terms.

12. Availability

The services are provided on an as-is and as-available basis. We do not guarantee uninterrupted, error-free, or always-current access.

13. No professional advice

Information on Dhaka Property is for discovery and convenience. It is not legal, financial, investment, tax, engineering, valuation, architectural, or regulatory advice.

14. Disclaimers

To the maximum extent permitted by law, Dhaka Property does not guarantee listing accuracy, legality, availability, ownership, title, possession, construction quality, approvals, RERA compliance, user identity, transaction completion, leads, sales, rentals, or returns.

15. Limitation of liability

To the maximum extent permitted by law, Dhaka Property will not be liable for indirect, incidental, special, consequential, punitive, or loss-of-profit damages arising from use of the services.

16. Indemnity

You agree to indemnify Dhaka Property against claims, losses, damages, penalties, costs, and expenses arising from your listings, content, communications, transactions, breach of these Terms, violation of law, misrepresentation, fraud, or unauthorized use.

17. Suspension and termination

We may suspend, restrict, remove content, disable features, or terminate access if we believe a user or listing violates these Terms, law, platform policy, security requirements, payment obligations, or user safety.

18. Intellectual property

Dhaka Property owns or licenses the platform, brand, design, software, databases, workflows, APIs, icons, logos, content layout, and related intellectual property. You may not copy, modify, distribute, sell, reverse engineer, or exploit the platform except as permitted by these Terms.

19. Privacy

Our Privacy Policy explains how we collect, use, share, and protect personal information. By using the services, you agree to the Privacy Policy.

20. Governing law

These Terms are governed by the laws of India. Nothing prevents users from approaching courts, consumer forums, RERA authorities, law enforcement, or regulators where they have a legal right to do so.

21. Changes

We may update these Terms from time to time. Continued use of the services after changes means you accept the updated Terms.
